Digital Millennium Copyright Act (DMCA) Notice – TVNADO IPTV

TVNADO (available at https://tvnado.us.com/) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), TVNADO has implemented a process for addressing claims of copyright infringement occurring on its website. This page outlines our DMCA policy, including how to submit a notice of claimed infringement, how to submit a counter-notice, and our designated agent information.

Notice of Claimed Infringement

If you are a copyright owner, or authorized to act on behalf of one, and believe that copyrighted material has been infringed upon through the TVNADO website, you may submit a written notification to our Designated Agent containing the following information:

  • Identification of the copyrighted work claimed to have been infringed: Please provide a clear and detailed description of the copyrighted work that you believe has been infringed. If possible, include the title, author, publisher, copyright registration number (if applicable), or any other identifying information that will allow us to accurately identify the work. For example: “The copyrighted work is the motion picture entitled ‘Example Movie,’ copyright registered under registration number PA123456789.”
  • Identification of the material that is claimed to be infringing: Please provide a specific description of the infringing material and its location on the TVNADO website. This should include the URL(s) where the infringing material can be found. Be as precise as possible to allow us to locate the material. For example: “The infringing material is a stream of ‘Example Movie’ located at https://tvnado.us.com/streams/example_movie.m3u8.” Vague descriptions like “all streams on the site” are insufficient.
  • Your contact information: Please provide your full legal name, address, telephone number, and email address. If you are acting on behalf of the copyright owner, please also provide the name and contact information of the copyright owner.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law: This statement must be made under penalty of perjury. A simple statement like, “I have a good faith belief that the use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law,” is sufficient.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed: This statement must be made under penalty of perjury. An example statement is, “I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.”
  • Your physical or electronic signature: If submitting a physical notice, provide your handwritten signature. If submitting an electronic notice, provide your electronic signature (e.g., typing your full legal name).

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. TVNADO takes copyright infringement claims very seriously and will investigate all valid notices received. However, we also reserve the right to remove or disable access to material that is claimed to be infringing, even if we are unsure whether the material actually infringes.

Counter-Notice

If you believe that material that you posted on the TVNADO website was removed or access to it was disabled by mistake or misidentification, you may file a counter-notice with our Designated Agent. The counter-notice must contain the following information:

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled: Please provide the specific URL(s) where the material was located before it was removed or access was disabled.
  • Your name, address, and telephone number: Please provide your full legal name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which TVNADO may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person: This statement is required by the DMCA.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled: This statement must be made under penalty of perjury. For example: “I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.”
  • Your physical or electronic signature: If submitting a physical notice, provide your handwritten signature. If submitting an electronic notice, provide your electronic signature (e.g., typing your full legal name).

Upon receipt of a valid counter-notice, TVNADO will forward it to the copyright claimant who submitted the original notice of claimed infringement. The DMCA allows the copyright claimant 10-14 business days to notify TVNADO that they have filed an action seeking a court order to restrain the alleged infringing activity. If TVNADO receives such notification, we will be unable to restore the material. If we do not receive such notification, we may replace the removed material or cease disabling access to it in 10-14 business days.

Repeat Infringer Policy

TVNADO has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright. We consider a repeat infringer to be any user who has been notified of infringing activity more than twice and/or has had their content removed from the TVNADO service more than twice.
